Agreement
This agreement refers to all the rights and obligations that the user (you, your) and Freelancerchina (we, us) have. Every visitor to our site must read these Terms and Conditions first. Once you sign up as a member, it is automatically considered that you agree with all of the terms stated here.
Our Status
Freelancerchina.com is an online platform designed to allow software freelancers and software buyers to find each other and fulfill their projects in the most convenient way.
We reserve the right to refuse to post, alter or remove any bid request, bid or other transmitted information. We may exercise this right without any advance notice to the individual submitting, including buyers and coders.
Both buyers and coders must understand that Freelancerchina is simply a platform for all transactions. If an irresolvable dispute arises during the transaction, buyers and coders must automatically agree that Freelancerchina is not liable in any way.
Service Buyers and Coders
User represents and warrants that User's content: (a) will not infringe upon or misappropriate any copyright, patent, trademark, trade secret, or other intellectual property right or proprietary right or right of publicity or privacy; (b) will not violate any law or regulation; (c) will not be defamatory or trade libelous; (d) will not be obscene or contain child pornography; (e) will not include incomplete, false or inaccurate information about user or any other individual; and (f) will not contain any virus or other computer programming routine that is intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information.
Buyer agrees that:
Buyer will not redistribute any of the content on Freelancerchina.com.
Buyer will not use Buyer's Account to post false or misleading project descriptions. Buyer will not post project descriptions that are inappropriate to Freelancerchina.com's audience, viewers, or visitors according to the judgment and discretion of Freelancerchina.com.
Buyer agrees to pay Gold Member fee if they cross the checkbox of Gold Member service when registering.
Buyer will not falsify their own or any other identity.
Buyer will comply with all Freelancerchina.com's policies.
Coder agrees that:
Coder will not redistribute any of the content on Freelancerchina.com.
Coder will not falsify their own or any other identity.
Coder will comply with all Freelancerchina.com policies.
Payment
Our charges are deducted from each transaction equal to or greater than $5. The part that is used to cover Paypal's service is deducted by the Paypal system. All payments must be made in US dollars. Freelancerchina reserves the right to suspend a withdrawal if the source of the funds is suspected to be fraudulent. Any funds received from an account having made a fraudulent deposit (e.g. stolen credit card) will be reversed immediately. If in a fraudulent payment situation a withdrawal has already been processed, you will be expected to return the funds to your Freelancerchina.com account or face account termination.
About the Ranking System
Buyers should leave feedback for the coder based on 5 aspects; these are:
1. Quality of the project
2. Rate of Response
3. Professionalism
4. Expertise grade and expense of the project
5. Punctuality in completing the project
Coder should rank the buyer basing on the following 5 aspects:
1. Professionalism
2. Communication and response
3. Clarity of instructions
4. Abidance to the original description of the project
5. Management
Each aspect has a full score of 5 stars. Please mark them from 1 to 5 out of 5. A guide to service coder feedback ratings is below:
5 stars, extremely satisfied
4 stars, very Satisfied
3 stars, satisfied
2 stars, not satisfied
1 star, extremely unsatisfied

Along with the rate score, you are also encouraged to leave a comment which will help to make the appraisal more valuable and informative
Accounts
Freelancerchina.com shall have absolute discretion as to whether or not it accepts a particular applicant or site for participation in the service.
About the Escrow System
The funds for a project can be transferred directly between the buyer and the coder or through our Escrow System.
How does our Escrow System work?
When you (coder and buyer) come to a consensus on all the details, we ask the buyer to deposit the money to an escrow account beforehand. Once the project is successfully completed and the buyer sends an acceptance advice about the outcome, we will release the payment to the coder.
With the escrow service, both sides can securely accomplish the project.
If the project is cancelled amicably, the money will be returned to the webmaster's account, partially deducted at the rate of 5% of the total deposit, whichever is greater. If there is a dispute over a project, Freelancerchina staff must be contacted before any money can be moved from the escrow account.
If a project is closed with arbitration, there are three possible outcomes:
1. Funds are returned to the webmaster's account minus a deduction.
2. Total funds are delivered to the coder's account and the commission deducted from this account
3. Funds are dispatched to both sides' accounts according to the final agreement and a commission is deducted from both sides according to the amount each side received.
Governing Law and Jurisdiction
Those who choose to access this web site are responsible for compliance with applicable local laws.
In order to protect the legal rights and resources of both buyers and coders, all users of the site affirm that they are legal adults, able to enter into contracts and are at least 18 years of age. Persons not meeting these requirements are not allowed to post bid requests or bids.
Those who choose to access this site from other locations do so at their own initiative and are responsible for compliance with local laws.
Violation
Members in violation of Freelancerchina's Terms and Conditions will be immediately deactivated. Freelancerchina.com may deactivate members with no prior notification. Members found in violation of the Terms and Conditions will not receive any credit or payment from Freelancerchina.com. Members that are terminated by Freelancerchina.com on any basis other than violation of these Terms and Conditions will be entitled to receive any payment due from Freelancerchina.com.
Copyright
All copyright on pictures and pages on this site are retained by Freelancerchina. You do not have the right to copy, sell, modify, distribute, publicly perform, prepare derivative works based on or otherwise use any of the site content in any way for any commercial purpose without the prior written consent of Freelancerchina or the rights holder. No copyright material can be posted on Freelancerchina. If you violate any of these terms, your permission to use the site will be automatically terminated.
Contact information
Freelancerchina accepts the obligation to store Personally Identifiable Information securely and confidentially without releasing it to any other third party.
Members agree not to post their e-mail address on the site, except in the "e-mail" field of the signup form, or when asked by Freelancerchina at any other time. There should be no need to give anyone your e-mail address. It is automatically provided if you choose a coder (or you are the coder chosen for) a project, and before that time you can use the message board to communicate. This does not only apply to e-mail addresses, but to all methods of communication, including phone, ICQ, AIM, MSN Messenger, etc...
We will screen your project and bid information automatically and manually. Anyone who is found to be exchanging or intending to exchange their contact information prior to the project's activation will have their account suspended or will be excluded from the service without payment.
Privacy Statement
Freelancerchina.com believes strongly in protecting our users' privacy. Please note that Freelancerchina, to the best of its ability, protects all data from external and unauthorized party access by the use of (but not limited to) firewalls, encryption and 3rd party security consultants. Additionally it also, to the best of its ability, protects site users from viruses via virus scanning software. However, no security system and/or virus system is 100% secure or 100% effective. Should sensitive data be confirmed as compromised, or a virus discovered on a Freelancerchina system, Freelancerchina will alert the affected User via email (to the address registered on the site). However, due to the nature of security and viruses, Freelancerchina strongly advises the User to take their own security precautions, such as personal virus scanning software, and/or encrypting sensitive communications. Given the nature of these matters, should a security compromise or virus incident occur, User agrees that Freelancerchina is not liable for the incident (in any way or kind) nor for any repercussions of such an incident (in any way or kind).
What type of projects are not allowed to be posted
Any request for copyright or illegal software, as well as illegal hacking tools and spam tools
Misleading Projects, posted without the intention to award or complete the project or posted only to receive pricing information
Projects that offer commission, equity compensation or request free services
Advertisements or service offers
Full time employment or recruitments
Projects related to adult content or businesses
Projects related to bulk email and spam, including but not limited to, bulk email hosting, scripts, programs, proxies, lists, and relay servers
